Legal Considerations and Best Practices in Implementing AI Code Generation in Open Source Software

With a large portion of new code being AI-generated through the use of tools such as GitHub Copilot, Cursor, Windsurf and others, understanding the legal implications is crucial for Indian open source contributors and maintainers. This talk will explore the current regulatory framework and practical compliance strategies for using AI-generated code in open source projects in India.
This 30-minute presentation will cover:
1. Current Regulatory Framework in India: An overview of India's approach to AI regulation, including government advisories on AI/LLM deployment, and India-specific legal interpretations of terms such as "copyright".
2. Recent Legal Developments: On-going or recently concluded legal cases in India that may have an impact on the use of AI, including ANI v. OpenAI (India); Doe v GitHub (US); and Thomson Reuters v. ROSS Intelligence (US).
3. Compliance Strategies: Guidance for implementing code audits and documentation practices to mitigate legal risks. Use of AI generated code without oversight strategies risks potential third-party IP violations, such as by mirroring another project's code.

The evolution of AI is interspersed with evolving laws and the legal ecosystem around it. This would be an interesting addition to the conference.

The proposed topic makes sense for an IndiaFOSS audience and the proposer clearly has relevant experience but the proposal needs to be significantly improved e.g. additional information about regulations in India and information about proven compliance strategies. The takeaways should also be updated, especially because the topic will be new to many in the audience. Without the key takeaways, it'll be unclear if this talk is geared solely towards experienced professionals/executives or if this is meant for a general audience
